The tendering process complied with the Local Government (General) Regulation 2005 (the Regulation). It was decided to call an open tender in accordance with clause 167 of the Regulation. The evaluation method included weighted price and non-price criteria with a price to non-price ratio of 20:80. The Tender allowed Tenderers the opportunity to submit a non-conforming tender on the basis that they had submitted a conforming tender. A Tender Evaluation Plan consistent with the Regulation . and the Conditions of Tendering in the RFT documents was prepared and signed by the Tender Evaluation Committee (TEC). The TEC consisted of three (3) representatives, all from Clarence Valley Council: Andrew Auglys - Open Spaces Coordinator (Acting); David Sutton - Open Spaces Manager (Acting) and David Newberry - Industry & Engagement Officer.

(i) Provisions for operational or maintenance

The upgraded lighting at Barnier Park & Ngayundi Yamba Sports Complex will renew the luminaire part of the assets. The poles, cables and switching gear condition remains unimproved. The works at McKittrick Park will achieve a full renewal of the existing asset, the project includes a 10 year service contract under which the Contractor will complete regular inspections, adhoc repairs if required and the systems will be serviced in line with the manufacturer’s recommendations.

The budgeted sum will need to be increased by $75,000 to allow for the additional $22,727.27 contract sum and 10% ($52,272.72) project contingency.

(h) Method of tender & assessment criteria:

MW21 Request for Tender Process. Tender Evaluation Committee (TEC) evaluated the submissions against the Mandatory Participation Criteria to ensure compliance with the Tender Evaluation Plan (TEP). The three (3) Tenders received were deemed compliant and were processed through to the evaluation criteria assessment. The TEC reviewed the three (3) Tenders against the non-price (technical) criteria independently and then as a group to form a consensus score. CONVIC Pty Ltd ranked first, Concrete Skateparks Pty Ltd ranked second. The TEC then reviewed the three (3) Tenders against the price (commercial) as a group. Concrete Skateparks Pty Ltd ranked first. After consideration of the tender submissions, scoring, and project reference checks, the TEC considered the offer from Concrete Skateparks Pty Ltd as the most advantageous and recommended this tender be accepted.

(i) Provisions for operational or maintenance

The facility will continue to be under Council’s Open Spaces assets and will be included into all future Open Spaces operational and scheduled maintenance programs.
